By accessing or using the GrowthPilot website (growthpilot.agency) or engaging our digital marketing services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or services.
GrowthPilot provides digital marketing services including but not limited to: SEO strategy, LinkedIn management, content marketing, PPC advertising, email marketing, social media management, analytics reporting, and related consulting services.
The specific scope, deliverables, timelines, and fees for each client engagement are defined in a separate Service Agreement or Statement of Work (SOW) agreed upon prior to commencement.
To enable us to deliver services effectively, clients agree to:
Fees are invoiced monthly in advance unless otherwise agreed. Invoices are due within 14 days of the invoice date. Late payments may result in service suspension and may attract a late payment fee of 1.5% per month on outstanding balances.
Ad spend for PPC campaigns is separate from agency fees and is managed in accordance with the agreed budget. GrowthPilot does not mark up ad spend unless explicitly stated in the Service Agreement.
Either party may terminate the service agreement with 30 days written notice. Upon termination, GrowthPilot will deliver all client-owned assets and data within 14 days. Outstanding fees for work completed up to the termination date remain payable.
GrowthPilot reserves the right to terminate services immediately in cases of non-payment, breach of these terms, or behaviour that is abusive, illegal, or harmful to our team.
Upon full payment of all fees, intellectual property rights in deliverables created specifically for the client (including written content, strategy documents, and campaign assets) are transferred to the client.
GrowthPilot retains ownership of its proprietary methodologies, frameworks, templates, and tools. The client receives a licence to use these as part of their deliverables but does not own the underlying frameworks.
Both parties agree to keep confidential any proprietary information shared during the engagement. This includes business strategies, pricing information, client data, and campaign performance data. This obligation survives termination of the service agreement for a period of two years.
Digital marketing results depend on many factors outside GrowthPilot's direct control, including search engine algorithm changes, platform policy updates, market competition, and the client's own business conditions. We do not guarantee specific rankings, follower counts, traffic volumes, or revenue outcomes.
We commit to professional, ethical, and best-practice execution of all agreed services and to transparent reporting of all campaign performance data.
To the maximum extent permitted by law, GrowthPilot's liability for any claim arising from these terms or the services provided shall not exceed the total fees paid by the client in the three months preceding the claim.
GrowthPilot is not liable for indirect, incidental, consequential, or punitive damages, including loss of profits, loss of data, or business interruption.

These Terms of Service are governed by the laws of the State of New York, USA. Any disputes shall be subject to the exclusive jurisdiction of the courts of New York.
We reserve the right to modify these Terms of Service at any time. Changes will be effective upon posting to our website. Continued use of our services after changes constitutes acceptance of the revised terms.
